Abstract

Based on a persuasive notion of evidentiary reasoning, and a subjective conception of the free conviction, the High Courts have excluded the in dubio pro reo principle from the content of the right of presumption of innocence, and thus from its scope of review on the assessment of evidence. Based on a model of rational assessment of evidence, the relevance of doubt in evidentiary reasoning requires a distinction to be made between three aspects: (i) whether the assessment must cover the reasonable doubts arising from the hypothesis of acquittal; (ii) whether the burden of proof must be the standard beyond any reasonable doubt; (iii) and whether the outcome must be an aquittal in the event that reasonable doubts are raised. © 2021 Jesus Barqun Universidad de Granada.
